Florida Judge Finds Traffic Stop Illegal Molly Hatchet Guitarist is Cleared

No Longer ‘Flirtin’ with Disaster in Port St. Lucie

DUI charges have been dismissed against Molly Hatchet lead guitarist David Hlubek. The Office of the State Attorney has abandoned its accusation of drunk driving after the trial judge agreed with defense counsel that the deputy broke the law when he stopped Mr. Hlubek’s car without legal authority.

Notorious DUI cop Peter Lamborghini received an anonymous tip claiming Mr. Hlubek was driving drunk. Lamborghini has received awards from Mother’s Against Drunk Driving (MADD) for his large number of DUI arrests, despite the significant percentage of them that do not result in convictions.

In this case, the deputy chose not to question the reliability of the source. The deputy also ignored the fact that Mr. Hlubek committed no traffic violation, and demonstrated no erratic or suspicious driving.

The judge agreed with this lawyer that anonymous tips are inherently unreliable, and granted our motion to suppress all of the evidence that the deputy obtained illegally.
After reviewing their options, prosecutors decided not to appeal the judge’s decision, and filed a dismissal instead.
