Some Folks Are Hard To Defend
For the most part, people call me for help after they have already been arrested. One of my first tasks is learning what the police know about my client and his or her case. A good starting point is often to ask, “Well, what did you tell them?”
The answer to this question is often at least temporarily discouraging. I am reminded of comedian Ron White’s now-famous line, “I had the right to remain silent, but I did not have the ability.”
Recently, a friend and colleague related to me a police tactic that I found irresistible. The police brought a man into their station, and left him in the waiting room with several other people. One by one, they called the people in for questioning, letting it be known that they were working on several different crimes.
At one point, a detective stuck his out the doorway and said, “Ok now I need to talk to the guy who robbed the gas station.” My friend’s client stood up and walked to the officer.
That case is going to be hard to defend.
